At a Council held at the Town Hall on Tuesday the 15th day of February 1803

Stephen Winchester, Joseph Walker & William Herndon Gent are appointed to inquire unto the best & cheapest mode of carrying off the water from the cross street leading to Mrs Gatewoods and from the lots adjoining sd cross street, and they are also impowered to agree with some person for that purpose

The petition of Seth Barton for leave to permit him to dig up the Streets at such places as shall be proper for the purpose of laying down pipes to convey the water from house to house in this Corp is granted agreeable to the prayer of the petitioner

This being the day appointed by law for the annual Election of 12 person to serve the Corporation the ensuing year as Mayor, Recorder, Aldermen & Common Councilmen the Free holders [Page 14] and Housekeepers being notified met at the Town Hall and having deposited their tickets in the ballot box upon examination thereof the greatest number of votes were in favour of the following persons to wit

And the following to wit Jas Brown, Wm Drummond, Geo French, James Smock, B Day, Thos Goodwin, Richard Johnson, & John Lewis being present proceeded to the choice of Mayor when George French Esq was duly elected and qualified to the office accordingly

They proceeded to the choice of Recorder when Benj'n Day Esq was duly elected and qualified to the office accordingly

They then proceeded to the choice of 4 aldermen when Chas Carter, Hugh Mercer, Richard Johnson & Alex Duncan were duly elected and the remaining six to wit Wm Drummond, James Brown, James Smock, Thos Goodwin, John Lewis, Fielding Lucas are common councilmen when the said William Drummond, James Brown, James Smook, Thos Goodwin & John Lewis qualified accordingly

John Chew is reelected Clerk of this Board

William Drummond was duly elected Chamberlain for the ensuing year

Thomas Legg elected Vendue Master and ordered that he give his bond & security at the next court

Barth'o Fuller is appointed Guager & Geographer for this Corp

Barth'o Blunt is appointed Clerk of Market

Alexander Duncan, William Drummond, Thomas Goodwin & Richard Johnson are appointed trustees of the market house for the ensuing year

James Brown is appointed to Rent the County Warf for the ensuing year

It appearing to the board that Richard Johnson elected to serve as an alderman on Monday last was not a freeholder at the time he was elected in this corporation The board proceeded to elect an alderman in his room, when William Drummond was duly elected

They then proceeded to Elect a Chamberlain in the room of said Wm Drummond when William Taylor was duly elected

Charles Carter, Alex'r Duncan & Wm Drummond qualified as Aldermen for this corporation according to law

William Taylor qualified as a common councilman in this Corporation according to law

Charles Carter, Alex Duncan & Wm Drummond qualified as aldermen for this Corporation according to law

William Taylor qualified as a common councilman in this corporation according to law

Alex'r Duncan, Thos Goodwin, John Lewis and Wm Taylor Gent or any 3 of them are appointed to settle with the late Chamberlain his acc't with the Corporation for the last year Also the acc't of the Sergeant, Overseers of the poor & Trustees of the Market House and make report thereof to the next Council

The comm'e appointed to settle with the late Chamberlain his acc't with the Corporation for the last year made report thereof by which it appears that the sum of 70 cents is due from Chamberlain

They also made report of the settlement of the Sergts acc't for the last year by which is appears the sum of $11.44 cents is due sd Sergeant

Ordered that each free male tithable person in this Corporation & the owner of Slaves above 12 years pay to the Sergeant One dollar, pr Poll, each Horse, Mare, Colt, or Mule one Dollar, on each riding carriage wheel one dollar, on each dray or cart four dollars, on each Dog 50 cents and three per cent on the amount of rents agreeable to the return & valuation of the Com'r of the Revenue, and that the Sergeant collect said taxes & pay by the same to the Chamberlain within three months from this day

James Brown, William Taylor, Henry White, & Jos Walker Gent are appointed to agree with some person to put the pumps in order & to keep them in repair for 12 months from the date of such agreement

William Drummond having stated to this board that he expected to be absent from town a greater part of the summer, he is thereupon permitted to resign as Chamberlain, and thereupon John Lewis was appointed in his room

George French, Alex'r Duncan, James Smock, and William Taylor Gen't are appointed to superintend the Overseers of the streets

Ordered that the Mayor do affix the assize of Bread in this Corporation from time to time as he shall see cause and publish the same

Upon motion made & seconded it is Ordered for reasons appearing to this board, that the ordinance respecting hogs going at large in this Corporation be suspended until the 10th day of November next, and that persons owning hogs in this corporation and now confined in penns or otherwise be directed to let them out and not suffered to keep them confined after the date period under the penalty of $5 for each hogg or pig to be recovered by the warrant before a single magistrate in the name of the Mayor for the use of the corporation and that the constable carry this order into effect

Ordered that Richard S Hackley Scd be paid the sum of $ [no value] for a bill for the use of this corporation ordered by Wm S Stone the former Mayor of this corporation and that the said Rd S Hackley be requested to send the said bill to the Mayor of this corporation by the opportunity

Ordered that the Chamberlain pay to Adam Darby $20 due to Moses Perry as Clerk of the Markett in the year 1798 as pr order of Council bearing date the 25th of June 1798

Ordered (for reasons appearing) to this board that the tax on a wagon the property of Geo Heiskell be remitted

Hugh Mercer G't having qualified as Magistrate for the County of Spotsylvania Thos Goodwin Gent who had the larger number of votes at the last election for alderman has succeeded to the office of alderman in the room of the said Hugh Mercer who qualified according to law

David Henderson is elected a common councilman in the room as Thomas Goodwin

David Henderson Gent qualified as a Common Councilman in the room of Thos Goodwin elected an alderman

This Board taking into consideration the present sickly season and finding that a company of comedians have come to this town for the purpose of performing in this corporation Be it ordered by the Mayor Recorder Alderman & Councilmen of the town & corporation of Fredericksburg that the said company of comedians be prohibited from Commencing any theatrical performance in this corporation until the 8th of October next under the penalty of $300 to be recovered by the action of Debt in the name of the Mayor for use of the corporation and be it ordered that provided the Mayor Recorder and Aldermen shall be of opinion that the health of the inhabitants of this corporation will not be affected by the commencement of the said theatrical performance prior to the said 8th day of October next they are hereby authorized to grant the said company liberty of performing before the said 8th October next

It is ordered that the Butchers & other persons that attend this market be prohibited from selling any meats in market on a Sunday [Page 22] between the 1st day of October and 1st day of June in each year, and any butcher or other person offending herein shall forfeit and pay to the corporation the sum of $10 for every offence to be recovered by warrant in the name of the Mayor for the use of the Corporation

Ordered that the trustees of the Market house, out of the money belonging to the said house do have the floor and yard next to the main street paved with brick and the railing repaired in such manner as they may think proper
